1. Design & Functionality

Empire Luxury Marketing specializes in creating bespoke digital experiences for luxury brands. We craft custom designs that reflect the premium nature of your brand. Unless otherwise agreed, we are not responsible for inputting text or images into your content management system. We offer professional copywriting and editing services for an additional fee. All graphic files should be supplied in an editable, vector digital format, and photographs in high resolution digital format. We can recommend premium stock libraries or source exclusive imagery for an additional fee.

2. Text & Images

We deliver web experiences developed using cutting-edge technologies. You retain responsibility for providing and/or approving all text and images unless our copywriting services are engaged. All content provided must be owned by you or licensed for your use.

3. Code & Testing

We test our work in current versions of major desktop and mobile browsers. We ensure that your digital presence is optimized for a range of devices, prioritizing those most relevant to your luxury audience. Custom compatibility for specific browsers or devices can be arranged for an additional fee.

4. Search Engine Optimization

While we implement best practices for search engine visibility, we do not guarantee specific rankings. The digital landscape is dynamic, and search engine algorithms frequently change. We strive to create content that resonates with both search engines and your discerning clientele.

5. Changes & Revisions

We understand that vision evolves. Our initial agreement outlines the scope of work and included revisions. Additional changes or revisions beyond this scope will be quoted separately. We’re committed to achieving your vision and will work flexibly to accommodate refinements that elevate your brand.

6. Updates & Support

Unless specifically included in your service agreement, we do not automatically update software or provide ongoing technical support. We offer premium maintenance packages to ensure your digital presence remains secure, up-to-date, and optimally performing. We strongly recommend implementing these to protect your brand’s online integrity.

7. Hosting Terms & SLA

Empire Luxury Marketing partners with premium hosting providers to ensure optimal performance and security for your digital assets. We strive for 99.9% uptime, excluding scheduled maintenance. Specific hosting terms and service level agreements are provided separately based on your unique hosting package.

8. Support Terms & SLA

Our support services are designed to provide swift, effective solutions. Response times vary based on the urgency of the issue, ranging from 1 hour for critical issues to 24 hours for minor concerns during business hours. Detailed support terms and service level agreements are provided based on your specific support package.

9. Domain Terms

We offer domain registration and management services as part of our comprehensive digital solutions. All domain services are subject to the policies of respective registrars. We will manage renewals for domains registered through us, provided your account is in good standing. You retain ultimate responsibility for domain renewals and usage compliance.

10. Intellectual Property

Upon full payment, you will own the rights to the custom design elements we create specifically for your project. Empire Luxury Marketing retains rights to proprietary code, processes, and any elements developed independently of your project. You warrant that all materials provided to us are owned by you or properly licensed for use.

11. General Terms

Confidentiality: We respect the confidential nature of our collaboration and expect mutual discretion regarding proprietary information.

Non-Solicitation: You agree not to solicit or hire our employees without our written consent.

Limitation of Liability: Our liability is limited to the total fees paid for the specific project in question. We are not liable for indirect or consequential damages.

12. Payment Terms

Our payment structure typically includes a 50% deposit before project commencement, with the remaining 50% due upon project completion or when the agreed project hours are reached, whichever comes first. Recurring services are billed monthly. We accept payments via secure electronic methods. Late payments may incur additional fees. Detailed payment terms are outlined in your specific service agreement.

13. Legal Summary

These terms constitute the entire agreement between Empire Luxury Marketing and the client. Any modifications must be in writing. This agreement is governed by [Your State/Country] law. If any provision is deemed invalid, the remaining provisions remain in effect. Neither party may transfer this agreement without the other’s permission.
